1:10 p.m. to 2:10 p.m. Law Firm General Counsels’ Forum Law
firms today face difficult and diverse risks, and dynamic professional liability and responsibility challenges. All firms now recognize the importance of effective risk management, and, on the other side of the coin, the reputational bruising, practical distractions, and financial consequences that can flow from lawyers’ misjudgments and professional lapses. Law firm general counsels and their deputies, as well as their colleagues on ethics committees, business intake committees, and the like, play a major role in managing their firms’ risks and challenges, and in helping their colleagues practice responsibly. This panel of experienced law firm general counsels will discuss current issues of critical importance to general counsels in law firms of all sizes, as well as problems and trends likely to affect firms in the future. Wolf is at the Door: Considerations When Facing a Potential Legal Malpractice Claim It
is an unfortunate reality of modern law practice for large and sophisticated law firms: eventually, someone is going to sue the firm or its lawyers for professional negligence. The drumbeats of trouble can often be heard well in advance of a complaint being filed or a demand for arbitration being served. What should law firm general counsel and senior leaders do when they hear the drums? This panel of veteran defense lawyers will discuss issues that firms should consider in mounting the strongest possible defense to anticipated malpractice claims (or perhaps suppress them altogether) and to avoid or at least mitigate the financial, personal, reputational, and practice management harms such claims can produce.

1:05 p.m. to 2:05 p.m. Recurring Professional Responsibility and Liability Traps in Transactional Practice
Transactional
practices routinely spawn the most severe and often the most complicated professional liability claims that law firms face. Third-party liability arising out of transactional practices has vexed law firms for years. In addition, lawyers with transactional practices commonly encounter difficult conflict of interest issues and other professional responsibility challenges. Sometimes, lawyers miss seemingly obvious red flags. Issues that might have been avoided or dealt with easily when they first surfaced fester when handled too casually or overlooked. This program will examine some thorny professional responsibility and liability problems that transactional lawyers face, as well as recurring issues that can test lawyers and law firm general counsels. Presenter: Douglas R. Richmond, Aon

Care of Our Own: Lawyer Well-Being Programs
It
is now clear that lawyers’ mental health should be a major concern for law firms. Studies have revealed that lawyers experience disturbing rates of anxiety, depression, and stress; numerous lawyers qualify as problem drinkers; substance abuse plagues our profession; and a distressing number of lawyers have contemplated suicide. Recently, the profession has had to grapple with the effects of the COVID-19 pandemic. Fortunately, many firms have developed lawyer well-being programs which have become an essential aspect of practice management, and which are critical to recruiting and retaining talent, and to supporting valued colleagues. This panel of well-being program leaders will discuss how firms can best approach lawyer well-being issues and strategies for developing and implementing successful well-being programs.
